Inactive: HOT: AB-340: CEQA Noncompliance

UPDATE: This legislation was referred to the Committees on Natural Resources and also Judiciary but no action has been taken since 3-27-23.

AB-340 was introduced by Assembly Member Vince Fong on 1-30-23.

This Bill would require that alleged grounds for noncompliance with CEQA be presented to the public agency in writing at least 10 days before the public hearing on the project before issuing the notice of determination. This bill would also prohibit written comments provided after that date from being used as a basis on which an action or proceeding may be brought.
