APPROVED: ADU Improvements

UPDATE: This legislation was approved by signature of the Governor on 9-28-22.

SB 897 was introduced on 2-1-22 by Senator Wieckowski.

This bill would improve the ADU legislation including:

  • Increase the maximum height of a rear yard ADU to 18' for detached buildings, and 25’ for attached units.

  • Local agencies may allow an additional 2 feet in height to accommodate a roof pitch that is aligned with the roof pitch of the primary dwelling unit.

  • Prohibits local agencies from requiring parking for ADU's.

  • Prohibits the requirements for sprinklers in the existing primary dwelling.

  • Prohibits permit denials for ADU’s because of building standard violations.
