AB-1317 was introduced by Assembly Member Carillo on 2-16-23.
This bill would require property owners to separate the price of rent from the price of parking. Tenants would be provided with first right of refusal to parking spaces to any available parking spaces on site, even if spaces are not available at the start of their lease. Property Owners would be required to provide tenants with an annual itemization of the market rate cost of parking for the parking spaces that are included in their lease.
Residential leases and rental agreements commencing after January 1, 2024 would be required to reduce the rent by the amount of the market rate cost of parking before imposing any increase on the rental rate.
Residential properties with individual garages would be exempt from these provisions.
