AB-323 was introduced by Assembly Member Holden on 1-30-23.

This Bill modifies the existing density bonus law. Projects designated for affordable housing intended for owner-occupancy, shall prohibit a developer from petitioning for a change of use for that parcel, unless they can prove that none of the applicants for owner-occupancy can qualify for the unit per the income limitation requirements. This bill would apply to all cities, including charter cities in the state.
