AB 3122: Objective Planning Standards

AB-3122 was introduced by Assembly Member Kalra on 2-16-2024.

This bill clarifies the language about modifications to projects that trigger the use of objective planning standards. Previously, projects with a "change" in square footage/unit count would qualify for a modification. Under this legislation, the language would specify "increases" and "decreases" in lieu of "changes: as triggers.


Projects utilizing the objective planning standards, would include modifications as follows:

  • 15%+ Increase of square footage

  • 15%+ Decrease in the number of residential units

OR

  • 5%+ Increase in square footage

  • 5%+ Decrease in number of residential units

  • The use of objective standards is required to mitigate/avoid adverse impact on public health or safety.
