AB 1878: Tribal Housing Program

UPDATE: This legislation was approved by the Committee on Housing/Community Development on 3-20-24 and is being routed to the Committee on Appropriations.

AB-1878 was introduced by Assembly Member Garcia on 1-22-2024.

This bill would remove HCD's authority to act on behalf of the tribal housing authority. HCD would still be required to provide technical assistance for these projects including outreach and education. In addition, HCD would be authorized to waive requirements for affordability levels, unit mix requirements, timeline requirements, service area requirements, and other requirements related to the housing elements.

This bill also creates the Tribal Housing Advisory Committee, which would be composed of members who are tribal representatives, with knowledge, experience, and expertise in the are of tribal housing and sets forth the requirements for that committee.
