CANCELLED: HOT: Housing Restriction in Moderate-Very High Fire Zones

Updated: Sep 16, 2022

UPDATE: This legislation is under review. It passed the Government and Finance on 3-16-22. It was scheduled to be heard in the Committee on Housing on 3-22-22, but was suspended by the author.

SB 1292 was introduced on 2-18-22 by Senator Stern.

This bill was previously written to revise rear and side-yard setbacks for ADU projects, allowing the local agency to determine the setbacks. (currently set at a maximum of 4' for side and rear setbacks)

Since it's introduction, it has been radically altered and no longer relates to ADU's. Now it permits city and counties to restrict housing development in moderate, high, and very high fire hazard severity zones.
