HOT: SB 1465: State Building Standards

SB-1465 was introduced by Senator Archuleta on 2-16-2024. It is Co-Authored by Senator Becker.

This bill would modify the State Housing Law and allow health officers to determine if a building is deemed a "substandard building" in cases where it endangers the life, limb, health, property, safety, or welfare of the occupants of the building. This definition could also be applied to a portion of a building as well. The legislation outlines a long list of conditions which can be used to deem a building a "substandard building."


It also modifies the definition of the term "residential rental unit" to mean any unit rented "by a tenant" in a building or portion thereof. In cases of illegal occupation, the enforcement agency would be prohibited from abatement proceedings. Property Owners would be required to declare, under penalty of perjury, that the occupant is not a legal tenant.
